Public Notice: eCitizen Payment Gateway

The Anti-Counterfeit Authority wishes to inform all our stakeholders that the integration with eCitizen payment gateway is complete. This is in compliance
with the presidential directive on payment for government services.

All ACA import permit applications shall be lodged via Trade Facilitation Platform (TFP) accessed at https://tfp.kenyatradenet.go.ke which has integrated
payments through eCitizen payment gateway.

ACA has integrated the IPR recordation program with eCitizen and transitioned payments for the following services; Application to record intellectual property rights, Application for renewal of recordation of intellectual property rights, Application to continue recordation on change of ownership, Notice of change of name, Application for official search, Application for admission as an IPR agent and Application for renewal of registration as an agent.

Stakeholders are further notified that ACA enforcement services shall be paid for on the eCitizen platform through M-pesa paybill 222 222 as follows:

Anti-Counterfeit Authority Participates in KCA University’s Research and Innovation Week

The Anti-Counterfeit Authority (ACA) was honored to participate in the 3rd Innovation and Industrialization Week at KCA University, themed “From Research to Market: Innovate. Commercialize. Transform.” The closing ceremony of the annual event hosted by the university was today graced by the Dr. Robi Mbugua Njoroge, Executive Director of ACA, who was the Chief Guest and keynote speaker.

In his keynote address, “Innovation, Intellectual Property, and the Future of Industrialization,” Dr. Njoroge emphasized the importance of robust intellectual property (IP) framework in promoting Kenya’s industrial advancement and in safeguarding the work of innovators against counterfeiting.

Strengthening Integrity in Procurement: A Potential Collaboration Between ACA and KISM

In an effort to combat the growing challenges of counterfeiting within Kenya’s procurement and supply chain sectors, the Anti-Counterfeit Authority (ACA) team recently had the privilege of meeting with Mr. Kenneth Matiba, CEO of the Kenya Institute of Supplies Management (KISM) and his team. Led by Executive Director Dr. Robi M. N. King'a and accompanied by Director of Enforcement Mr. Yussuf Osman, Director of Research Dr. John Akoten, and Deputy Director of Education and Public Awareness Ms. Agnes Karingu, this courtesy visit was a significant step toward exploring key areas of potential collaboration.

During the meeting, discussions focused on identifying collaborative efforts that could enhance the integrity of procurement practices in Kenya. The team explored several initiatives aimed at promoting genuine products in the marketplace. Notably, the conversation highlighted the importance of joint awareness campaigns designed to educate both procurement professionals and consumers on the risks associated with counterfeit goods.

Implementation of Phase IV of The ACA IPR Compliance Program for Imported Goods Under The Recordation Of Intellectual Property Rights

Pursuant to the provisions of the Anti-Counterfeit Act No. 13 of 2008 (Section 34B) and the Anti-Counterfeit {Recordation} Regulations LN 118/2021 (R4) as read with Article 40(5) of the Constitution of Kenya 2010: The public and stakeholders are hereby notified that:

Following the successful implementation of phases I, II and III of the ACA pre-import permit program, the Authority is further expanding the program with effect from November 1, 2024 to incorporate additional selected HS Codes. This phase also enhances the regulation of chapters already regulated in preceding phases.

Meeting with Cement Manufacturing Sub-Sector Leaders to Tackle Cement Adulteration and Counterfeiting Concerns

Today the Anti-Counterfeit Authority (ACA) Executive Director, Dr. Robi Mbugua Njoroge, met representatives of the Kenya Association of Manufacturers (KAM) Cement Manufacturing Subsector, led by Chair Mr. Mohit Kapoor. The meeting discussed ways of addressing the growing challenge posed by unscrupulous traders involved in repackaging cement and infringing on intellectual property rights, posing a significant risk to the safety of construction projects and deceiving consumers.

As we reflect on the remarkable success of the Second International Symposium on Intellectual Property Protection and Enforcement (ISIPPE 2) held in Nairobi, we are reminded of the immense progress we have made in our fight against the trade in counterfeits. This year’s conference, themed “Uniting Against Counterfeiting for a Healthy and Safe Future,” brought together key global players, demonstrating the importance of international collaboration in securing intellectual property (IP) rights and protecting consumers.

The presence and active participation of international agencies such as the World Intellectual Property Organization (WIPO), the Japan Patent Office (JPO), and various African and European counterparts signaled the growing global commitment to combating counterfeiting. Their participation showcased how governments, IP enforcement agencies, and businesses can work together to develop robust frameworks for enforcement and regulation. The dialogue and partnerships fostered during ISIPPE 2 have laid the groundwork for stronger future collaborations.

Authority Strengthens Enforcement Efforts Against E-Commerce Counterfeiting Through Training

Nairobi, Kenya – August 21, 2024: The Anti-Counterfeit Authority (ACA), in collaboration with GIZ Trade Kenya, has commenced a two-day training program aimed at bolstering the Authority’s capacity to tackle the growing threat of counterfeit goods in the e-commerce sector. The training, which targets senior management and technical personnel, is designed to equip participants with the requisite knowledge and tools to effectively combat the proliferation of counterfeit goods on digital platforms.

The rise of e-commerce has significantly transformed the global marketplace, creating vast opportunities for economic growth and innovation. However, this expansion has also facilitated the entry of counterfeit goods into the market, leading to substantial economic losses and posing significant risks to consumer safety. It is estimated that counterfeit trade in e-commerce contributes to global economic losses exceeding $500 billion annually, with an increasing number of consumers unknowingly purchasing substandard and potentially harmful products.

FCC Tanzania Delegation Visits ACA Kenya in Benchmarking Exercise to Enhance Cross-Border Anti-Counterfeit Measures

Today, the Anti-Counterfeit Authority (ACA) welcomed a delegation from the Fair Competition Commission (FCC) of Tanzania for a benchmarking visit focused on ACA's Recordation program particularly targeting deter entry of counterfeit imports in to the Tanzanian market.

The FCC delegation, led by ICT Manager Mr. Hatibu Idrissa, underscored the importance of the visit as an opportunity to understand Kenya’s experience with the IPR recordation process. “We are looking at learning from our Kenyan counterparts right from inception including the legal overhauls, to automation and the system maintenance and addressing challenges” said Mr, Idriss. He said the team looked forward to gaining valuable insights that will inform the implementation of similar initiatives in their country.

Today, the Anti-Counterfeit Authority (ACA) hosted a delegation from Holographic Asia Company, a leading Malaysian firm specializing in holographic authentication stickers. This meeting underscored ACA’s commitment to leveraging advanced technology to combat the growing menace of counterfeit products in Kenya and beyond.

The delegation from Holographic Asia was led by Mr. Foong Wan Hong, who presented an array of their latest innovations in holographic authentication. These state-of-the-art solutions provide robust protection against counterfeiting, offering a range of applications from securing pharmaceuticals to safeguarding consumer electronics and luxury goods.

Brand Protection Training for Law Enforcement Agencies Kicks Off in Nairobi

The Anti-Counterfeit Authority (ACA) is conducting a two-day Brand Identification Training session at Maarkson Suites Hotel in Hurlingham, Nairobi, on June 3rd and 4th, 2024. This event serves as a precursor to the upcoming 2nd International Symposium on Intellectual Property Protection and Enforcement (ISIPPE-2), part of the activities planned to commemorate World Anti-Counterfeit Day in Kenya.

In his opening remarks, Dr. Robi Mbugua Njoroge, the Executive Director of the ACA, emphasized the importance of collective efforts in tackling counterfeiting and illicit trade. The Anti-Counterfeit Authority (ACA) hosted Nairobi's small business traders' leaders at the Meridian Hotel in an event aimed at strengthening consultation mechanisms and increasing awareness of electronic Recordation declaration systems for imported goods.

Anti-Counterfeit Authority and Machakos County Sign MOU to Combat Counterfeiting

The Anti-Counterfeit Authority (ACA) has taken a substantial stride in the battle against counterfeiting by signing a Memorandum of Understanding (MOU) with Machakos County. The agreement, sealed by Machakos Governor Wavinya Ndeti and ACA's Director of Enforcement, Mr. Osman Yusuff on behalf of the ACA Executive Director Dr. Robi Mbugua Njoroge, signifies a united front in safeguarding intellectual property rights.

The signing ceremony took place at the sidelines of the Machakos County Industry Investment Forum and was graced by distiguised guests including the Cabinet Secretary of the Ministry of Industry, Trade, and Investment, Ms. Rebecca Miano and attended by the Principal Secretary State Department of industry Dr. Juma Mukhwana among other senior officers from the Ministry.

A Tripartite Meeting by Government Agencies to Combat Counterfeiting and Boost Trade Efficiency

The Kenya Revenue Authority Commissioner General, Mr Humphrey Wattanga, played host to the CEOs of the Kenya Bureau of Standards Ms. Easther Ngari and Dr. Robi Mbugua Njoroge of the Anti-Counterfeit Authority at his office at Times Towers in Nairobi.

ANTI-COUNTERFEIT AUTHORITY HOSTS FAIR COMPETITION COMMISSION (FCC) OF TANZANIA IN RENEWED REGIONAL EFFORTS TO COMBAT CROSS-BORDER TRADE IN COUNTERFEIT GOODS

Nairobi, 25th March 2024 – The Anti-Counterfeit Authority (ACA) and the Fair Competition Commission (FCC) of Tanzania have announced a renewed partnership aimed at intensifying their efforts to disrupt and combat the trade in counterfeit goods across the region.

The collaboration was formalized during a benchmarking and collaboration session, where a delegation from the Fair Competition Commission of Tanzania visited Kenya. Both institutions, mandated to combat counterfeiting and illicit trade while promoting fair trade practices, underscored the importance of concerted regional action in addressing this growing challenge.

ACA Management Trained on Productivity and Competitiveness Mainstreaming in a Move Towards Enhanced Productivity

ACA Management have today undergone training in productivity and competitiveness, with the aim of enhancing their overall productivity. The training was conducted by the National Productivity and Competitiveness Centre (NPCC) at a hotel in Machakos Town.

During the training program's opening session, Dr. Robi Mbugua Njoroge, the Executive Director of the Anti-Counterfeit Authority, emphasized the training's objective, which was to improve productivity not only for the authority as a whole but also for individual employees. The ultimate goal was to help them meet the Authority's targets and objectives.
