Public Notice No. 4/2022
Further to our Public Notice 3/2022 on the implementation of Recordation of Intellectual Property Rights and ACA Import Permit that will commence on 1st January 2023, and pursuant to the provisions of the Anti-Counterfeit Act No. 13 of 2008 (Section 34B) and the Anti-Counterfeit {Recordation} Regulations LN 118/2021 (R4): The public and stakeholders are further notified that:
The Authority has adopted a phased approach in order to facilitate continuous compliance by importers and brand owners. Products falling under the following HS Codes have been categorized under Phase One (1) of the implementation process and shall require ACA import permit application starting January 1, 2023.
Chapter 85: Electrical and electronics with HS Codes from 8508 to 8544.
A detailed list of ACA regulated HS Codes based on the East African Community Customs Union, Common External Tariff 2022 Version is available on the ACA website.

IPR Recordation program is a trade facilitation measure aimed at promoting legitimate and fair trade in Kenya though elimination of counterfeit imports. This aims to protect the health and safety of consumers and attract investment.
