Ruling on Revision

1. On 10th May, 2018 the Director of Public Prosecutions filed an application for revision after Hon. E. Mutunga, Senior Resident Magistrate dismissed Mombasa Chief Magistrate's Court Criminal Case No. 1426 of 2017 when the accused persons (respodents) failed to attend court on several occassions. He deemed the case to be a waste of the court's time and dismissed it under the provisions of Section 202 of Criminal Procedure Code. This court has been moved through the provisions of Section 362, 364 and 365 of the Criminal Procedure Code to revise the said order.
