Level of Public Awareness on Counterfeiting in Urban Kenya (2016)

Counterfeiting is a growing problem and has been repeatedly reported to flourish elsewhere in the world including Kenya. This paper will provide an analysis of public awareness and responses towards counterfeiting in Kenya.

Counterfeit trade is driven by the market forces of demand and supply. On the supply side, it is driven by market characteristics, production process and the institutional environment where it operates, for example, the ease with which the counterfeiters can continue to operate without being detected. On the demand side, product characteristics and consumer behaviour are the main drivers. The key players in counterfeit trade are the trademark owner, manufacturers of counterfeit products, the illicit distributors, outsourced manufacturers, custom authorities and other Government agencies. Each of these actors is affected differently.

The study seeks to determine the level of public awareness on counterfeiting. With this knowledge, the Agency will map the way forward in terms of awareness creation and possibly the most effective mode of public awareness that will reach majority of the people in the country. With the increased awareness levels, there will be enhanced intellectual property protection, improved productivity and reduced counterfeiting.

The study reveals that from various parameters that give an indication of the level of public awareness on counterfeiting in Kenya; the overall level of public awareness in urban Kenya is 52.39% as compared to 51.35% in 2015. This shows awareness level has increased.
